Massachusetts rules specifically permit that motion to be renewed after a jury is discharged without a verdict.\n\nThe jury had deadlocked 11-1 before Judge William Sullivan declared a mistrial. Reddington's team then challenged the strength of the trial record while also turning attention toward the conduct of the single holdout juror. Online, those separate issues blurred together and fueled accusations against Patrick that the Rule 25 filing itself did not make.\n\nOn October 1, Sullivan denied the renewed motion, ruling that the Commonwealth had presented enough physical and circumstantial evidence for a rational jury to determine whether Clancy committed the charged acts and whether she was criminally responsible.\n\nThat decision keeps a retrial possible, but it is not the final post-mistrial ruling. The defense is separately arguing that the mistrial was unnecessary and that another trial could violate double jeopardy.
