That means the spectacle we eventually watched was not the result of failed negotiations publicly known to us. The state pursued first-degree murder while the defense pursued lack of criminal responsibility. Both positions carried enormous consequences. A first-degree conviction means mandatory life without parole. A finding that Clancy lacked criminal responsibility could instead place her inside the state mental-health system, subject to evaluation and potential confinement.
