Foreperson Roni Carlson said the lone holdout acknowledged reasonable doubt but would not join that verdict. Nick Dargie said the holdout could not identify evidence supporting his position. Those reports gave the defense a new question to press: whether the mistrial was necessary at all, and whether more inquiry into the juror should have happened first.

At the September 29 hearing, Kevin Reddington renewed a Rule 25 request for a required finding of not guilty. He argued the prosecution's evidence was legally insufficient and sharply criticized the investigation. Prosecutor Shanan Buckingham answered that the Commonwealth had presented enough evidence to support the charges and noted that the defense had accepted key stipulations during trial.

A separate fight came from appellate attorney Martin Weinberg, who asked for access to sealed jury notes and sidebar material connected to the deadlock. The defense says those records may support its double-jeopardy argument by showing what the judge knew about the holdout before declaring a mistrial. Prosecutors warned against exposing deliberative material in a way that could chill future juries.

Judge William Sullivan left the major questions open and set November 2 for further proceedings.
