Why Doesn't Lindsay Clancy's Judge Get Any Say?!

If Lindsay Clancy is convicted of first-degree murder, a Massachusetts judge has no room to weigh in on her sentence at all. 
The charge carries mandatory life without parole. Not the illness, not the medication, not the wheelchair, not a single fact about who she was before January 24, 2023, when Cora, five, Dawson, three, and eight-month-old Callan died at their Duxbury, Massachusetts home. The judge doesn't get a say. Neither does the jury, once they've reached that verdict. 
Lindsay is pleading not guilty by reason of insanity. She's a former labor and delivery nurse. Prosecutors say roughly three months before the killings, she typed something about her older children into her phone, a note a prosecutor later read aloud in court. The defense says she'd been begging the medical system for help for weeks and was handed prescriptions instead. She's permanently paralyzed after going out a second-story window the night her children died. 
The other possible outcome isn't freedom either. A finding of not criminally responsible sends her to a locked state psychiatric hospital with periodic reviews to determine whether she can ever safely return to a community. She's already been in state custody since 2023. 
Two rigid outcomes, and nothing in between since prosecutors dropped the lesser charges that once existed. Jury selection began July 20 in Plymouth Superior Court, and whichever way this goes, one number, life without parole or indefinite commitment, is the only thing waiting on the other side. 
Patrick Clancy is on the defense witness list. He and Lindsay have separately sued her healthcare providers, arguing the treatment she received played a direct role in what happened.
