What Lindsay Clancy's Holdout Did With a Trial Exhibit

Lindsay Clancy holdout juror accounts are revealing what other jurors say happened during seven days of deadlocked deliberations in Plymouth Superior Court. The final split was 11-1 in favor of finding Clancy not guilty by reason of lack of criminal responsibility, according to jurors who have spoken after the mistrial. 

The most striking account comes from juror Nick Dargie. He told ABC News that the lone holdout would sometimes scroll on his phone while others were speaking and could not identify evidence or witness testimony that explained his position when Dargie pressed him. Dargie also described seeing the man take an exercise band from the evidence bag, tie it around an empty water bottle, and pull on it. The band had been admitted as a trial exhibit. Dargie said he was shocked by what he saw. 

Foreperson Roni Carlson says the jury came even closer to a verdict. Carlson said the holdout acknowledged having reasonable doubt, which led her to start filling out and signing the three verdict forms. She says he then refused to agree that Clancy was not guilty by reason of insanity. 

The jury had already told Judge William Sullivan that one member was not following the court's reasonable-doubt instructions. Sullivan questioned jurors individually, repeated the law, and sent them back to continue deliberating. The defense asked that the holdout be removed, but he remained on the panel. Sullivan declared a mistrial on September 4 after the jury still could not reach unanimity.
