The death penalty is gone from Nick Reiner's case. DA Nathan Hochman announced the decision after conversations with Jake and Romy Reiner and a review of the case. Sources say Rob and Michele Reiner's lifelong opposition to capital punishment factored into the decision. The parents who spent their final months trying to keep their son stable reportedly didn't believe in the death penalty — even for the person accused of killing them.Maximum sentence is now life without the possibility of parole. But a conviction requires proving Nick was criminally responsible for what he did, and his defense will likely rest on his documented mental illness. He's been diagnosed with schizophrenia and schizoaffective disorder. A judge found him gravely disabled and placed him under a conservatorship in 2020. Sources say his medications were changed three to four weeks before the murders and he deteriorated rapidly.In California, the defense has to prove insanity — the opposite of Massachusetts, where Lindsay Clancy's jury deadlocked because the prosecution couldn't prove she was sane. California eliminated diminished capacity, so there's no middle ground. And the lying-in-wait allegation says Nick planned this, which directly contradicts any claim that he was too ill to understand what he was doing. After the murders, sources say Nick checked into a hotel where staff found blood in the shower. The insanity defense has to overcome all of it.
