Caleb Flynn Court Coverage Day 1: FBI and K9 Found WHAT?

Two different searches were aimed at the same basic question in the Caleb Flynn case: was there evidence outside the home supporting the presence of the burglar described by the defense?

Deputy David Laycox of the Preble County Sheriff’s Department testified about searching the property with K9 Hayes, a tracking police dog.

Laycox said Hayes located a strong scent near the garage. He testified that the dog tried to enter the garage, where the scent appeared stronger, before conducting a perimeter search around the property.

According to Laycox, Hayes did not locate a scent trail showing a person leaving the scene. The dog instead returned to the area where the strong scent had been detected and again tried to enter the home.

Laycox called the result a negative alert for a suspect leaving the property.

Cross-examination prevented that testimony from becoming more definitive than the search actually allowed. Laycox acknowledged that Hayes failing to detect an outgoing scent did not eliminate the possibility that someone left the house.

FBI Agent Michael Tom testified about a broader canvass of the neighborhood.

Tom said he questioned neighbors and other people in the area about whether they had seen a suspected burglar. He also looked for doorbell-camera footage that might have captured or helped identify a person outside the Flynn home.

Tom testified that nothing was reported.

The significance of both witnesses comes from the central disagreement in Caleb Flynn’s trial. Prosecutors allege Caleb killed his wife, Ashley Flynn, and staged their home to appear as though a burglary had occurred. Caleb has pleaded not guilty, and his defense maintains that the home invasion was real.

Laycox and Tom described searches that did not produce an outgoing K9 trail or a reported sighting. Laycox also made clear under cross-examination that his K9 work could not exclude an intruder simply because Hayes did not find that trail.
