Caleb Flynn Trial Day 2: David Hammond Never Found WHAT?!

David Hammond's cross-examination in the Caleb Flynn trial put one missing piece squarely in front of the jury: investigators never recovered the firearm used on Ashley Flynn. Hammond, a special agent with the Ohio Bureau of Criminal Investigation, also testified that he never interviewed Caleb Flynn during his work on the case. 

Defense questioning moved from what investigators collected to what they did not do. Hammond said he did not weigh the refrigerator that was positioned against the garage entry door, and he did not try to move it. Earlier, Hammond had testified that the damage around that door did not look consistent with burglaries he had investigated. 

The defense then offered another explanation for how someone could have entered the garage. Counsel presented a theory that a person could have used a garage-door signal to open the door rather than forcing it. That was a defense theory raised during cross-examination, not a finding Hammond testified had been established. 

Caleb Flynn, 40, has pleaded not guilty to charges including aggravated murder in the death of his wife, Ashley Flynn, 37. Prosecutors allege Caleb killed Ashley and staged the Tipp City home to resemble a burglary. The defense says a real intruder killed Ashley and investigators rushed to blame Caleb. 

On redirect, prosecutors returned to forensic testing. Hammond testified that gunshot residue is fragile evidence and said it is not used that often. His answer gave the state a response to questions about what forensic evidence investigators did or did not pursue, but it does not change the basic point raised on cross: the firearm itself was never recovered. 

This portion of Hammond's testimony gave jurors competing ways to view the investigation. The prosecution has used his scene observations to support its staging theory. The defense used cross-examination to underline missing evidence, investigative choices, and an alternate way the garage could have been opened.
