Caleb Flynn Court Coverage Day 2: What Hammond Says Investigators Never Recovered

David Hammond's cross-examination gave the defense room to challenge the investigation behind the Caleb Flynn prosecution. The Ohio Bureau of Criminal Investigation agent testified that investigators never found the firearm used on Ashley Flynn, Caleb Flynn's wife and the murder victim, and Hammond said he never interviewed Caleb himself. 

The garage evidence also came under closer scrutiny. Hammond had testified for prosecutors that the damaged garage-door handle did not resemble forced entries he had seen in burglary investigations. On cross, however, he said he did not weigh the refrigerator positioned against that door and did not attempt to move it. 

Defense counsel offered a separate explanation for entry into the garage: someone could have used a garage-door signal to open it. The suggestion was presented as a defense theory during cross-examination. Hammond did not testify that investigators established that scenario as what happened. 

Caleb Flynn, 40, has pleaded not guilty to all 11 charges against him, including aggravated murder. Prosecutors allege he killed Ashley Flynn, 37, and staged their Tipp City home to look like a home-invasion burglary. The defense maintains that Ashley was killed by an intruder and says investigators rushed to judgment against Caleb. 

When prosecutors took Hammond back on redirect, the questioning turned to gunshot residue. Hammond testified that residue is fragile evidence and said it is not used that often. The state used that explanation to put context around one category of forensic evidence after the defense challenged the scope of the investigation. 

Cross-examination did not erase Hammond's earlier opinion that the scene was staged, and redirect did not erase the concessions he made. Jurors heard both: an investigator standing behind his scene assessment, and a defense team pointing to an unrecovered firearm, untested assumptions, and an alternate way into the garage.
