What Caleb Flynn's Defense Conceded Before Witnesses

Before the prosecution could turn Caleb Flynn's affair into a courtroom reveal, his own defense put it in front of the jury. Emily Smith opened with a verse from Proverbs, admitted Flynn was unfaithful and had lied about it, then drew the distinction the defense needs jurors to keep: marital betrayal is not proof of murder. 

That argument is being tested against the state's theory of a staged burglary. Flynn maintains that somebody stole his 9mm handgun from his Ford truck, entered the family's Tipp City home and killed Ashley Flynn. Prosecutors allege there was no real intruder and that the scene was arranged to support that story. 

BCI Special Agent David Hammond testified that the garage entry door did not show the signs of forced entry he expected to see. The defense challenged that conclusion, pointing out that the locks were unlocked and pressing Hammond on limits in the scene examination. The gun investigators believe was used has not been recovered. 
Then there is the evidence that brings the marriage itself into the courtroom. The woman prosecutors connect to Flynn's alleged affair is expected to testify, and the couple's daughters are also witnesses. The judge has restricted video of the juveniles while permitting audio recording of their testimony.

The towel found over Ashley's head is treated with the context trial testimony supplied: the first officer said Flynn reported placing it there after a 911 dispatcher instructed him to cover her head. Flynn has pleaded not guilty.
