Lindsay Clancy's Defense Claimed WHAT About the Evidence?!

Kevin Reddington's renewed Rule 25 motion after the Lindsay Clancy mistrial sounded, at first glance, like the defense had abandoned everything it argued at trial. The same case that focused on postpartum psychosis and lack of criminal responsibility suddenly included a claim that prosecutors had not produced enough evidence to prove Clancy killed her three children at all. 

That apparent contradiction is exactly why the filing exploded online. Some people interpreted it as a new theory involving Patrick Clancy. The motion did not accuse Patrick of the killings and did not identify an alternate suspect. It was a legal sufficiency challenge: Reddington argued that the Commonwealth's trial evidence was too speculative to support a conviction and separately argued that prosecutors failed to overcome the defense evidence on criminal responsibility. 

Massachusetts Rule 25 allows a judge to enter a required finding of not guilty when the evidence is legally insufficient. It also allows a renewed motion after a jury is discharged without a verdict. That is what happened here after the jury deadlocked 11-1 and Judge William Sullivan declared a mistrial. 

Sullivan rejected the renewed motion on October 1, finding that prosecutors had presented enough physical and circumstantial evidence for a rational jury to decide the murder charges and Clancy's criminal responsibility. The ruling does not resolve the entire post-trial fight. Reddington's team continues to challenge the mistrial itself, including the handling of the lone holdout juror and whether another trial would violate double jeopardy. 
The Rule 25 bid failed. The strategy behind it still matters because it shows exactly how the defense plans to attack any path toward a second jury.
