legalities of recording Boos? (and etiquette)

In this Boo, I respond to Simon's (sm2n) discussion about companies using social media to their benefit rather than trying to shield themselves from the Internet's ability to make "free" what they would otherwise charge for, such as touring a facility, where pictures on Facebook, Google+ or Twitter could render taking a tour useless.

But, this sparked another curiosity of mine: Laws and Etiquette for recording Boos. I'm less concerned with laws, as they will vary by jurisdiction; but what about etiquette? When should we tell others we're recording and that they might be included? What if they object? Your thoughts?
