Bryan Kohberger Isn't Exactly Saying He's Innocent

Bryan Kohberger is not exactly claiming he is innocent, and the difference matters more than almost anything else in his petition to withdraw his guilty plea in the University of Idaho murders.

The statement he provided to the New York Times says his actual innocence is his truth. Read as a legal claim, that sentence does very little. Read as a psychological one, it does an enormous amount, because it relocates the question from something a court could test to something only he has access to.

Tony Brueski works through it with psychotherapist Shavaun Scott, more than thirty years across private practice, community mental health, crisis teams, and forensic programs.

This episode covers the architecture of the reversal. The four separate admissions in open court. The nine-page questionnaire he signed confirming he understood his rights and the consequences. The waived appeal. Then twelve months at the Idaho Maximum Security Institution with no trial ahead of him and no proceedings to prepare, followed by a self-filed petition and a phone call to a national newspaper.

That is one person's account of one moment in a room, not a clinical judgment, and it is worth asking a clinician whether an instinct like that tracks anything real.

One more piece of the record matters here. He waived his right to appeal as part of the agreement, which is why this arrived as a post-conviction petition rather than an ordinary appeal, and that procedural detail shapes every option available to him now.
