The Lindsay Clancy jury split 11 to 1 in favor of acquittal by reason of insanity. The holdout reportedly acknowledged he had reasonable doubt about Clancy's criminal responsibility. Then he allegedly refused to apply the legal standard the court instructed him to follow — collapsing seven weeks of trial into a mistrial on September 4.
Defense attorney Bob Motta joins the show to analyze the behavioral and legal dimensions of what happened inside that deliberation room. Multiple jurors have now spoken publicly, describing a holdout who wouldn't review the medical or toxicology evidence, reportedly spent time scrolling his phone during deliberations, and when pressed for any evidentiary basis for his position, allegedly had none.
Motta examines what drove a juror to acknowledge doubt and still refuse the verdict that doubt required — whether this reflects a bias against mental illness defenses, a refusal to accept postpartum psychosis as a legitimate medical condition, or something else entirely.
