Caleb Flynn's Defense Started With WHAT in Opening?!

The Caleb Flynn defense did not begin by fighting every ugly fact. Emily Smith began with Proverbs, acknowledged that Flynn had an affair and lied about it, and told jurors those admissions describe a failed husband without answering who killed Ashley Flynn. That is the line the defense is asking the jury to hold through the entire case. 

Flynn's version is that a burglar took his 9mm handgun from his Ford truck and entered the Tipp City home while he and the couple's daughters were nearby. Prosecutors allege Flynn created the burglary story after killing Ashley and staging the scene. The gun remains missing. 

The state's scene evidence is already under attack. BCI Special Agent David Hammond testified that the garage entry door lacked signs he associated with forced entry. Defense questioning emphasized that the locks were unlocked and that Hammond could not say when the damage around the door occurred. 

The private-life evidence now has witnesses attached to it. Prosecutors have identified the woman tied to Flynn's alleged affair as a witness, while Flynn's daughters are also expected to testify. The court will keep video cameras off the juveniles but has allowed audio recording of their testimony. 

Tony Brueski, Robin Dreeke and Jennifer Coffindaffer examine whether conceding the affair gives the defense credibility or simply clears the way for harder evidence. They also correct one early scene assumption: the towel over Ashley's head was not unexplained conduct in the trial record. The first officer testified that Flynn said the dispatcher told him to cover her head. Flynn has pleaded not guilty to all charges.
