Caleb Flynn Told His Mistress WHAT Before Calling 911?!

Caleb Flynn's defense wants jurors to separate a failed marriage from a murder charge. Prosecutors want them to connect the private messages to the emergency call. That collision is now one of the clearest fights in the trial. 

Caleb called 911 from his Tipp City home and said an intruder had broken in and shot Ashley Flynn. The released audio has him reporting two shots to her head, mentioning the open garage, and telling dispatch that his daughters were in the house. Prosecutors say the call must be heard against more than 100,000 messages exchanged during an affair. Paul Watkins told jurors that some messages attributed to Caleb described trying to think of ways to kill Ashley without going to jail and said he would do it "in a heartbeat" if hell were not the consequence. 

The defense has not asked the jury to admire Caleb's conduct. Emily Smith acknowledged the affair in opening statement and argued that a man can fail as a husband without being a murderer. Caleb has pleaded not guilty, and the state still carries the burden of proving the charged crimes beyond a reasonable doubt.
