Siders Case: One Defendant Can’t Be Tried — Who’s Next?!

One defendant in the Siders family case has already been found unable to stand trial. The other three have asked the court to evaluate them too. Gary Siders Sr. was declared incompetent and not restorable on September 9, after a forensic evaluation concluded his condition would not improve enough for him to understand the proceedings or assist his lawyer. 

That ruling does not decide whether the allegations against Gary Sr. were true. It decides whether the criminal case can constitutionally move forward against him. He remains free on a recognizance bond with GPS monitoring while Vinton County Prosecutor William Archer considers dismissal or civil commitment.
 
Meanwhile, Elizabeth Siders pleaded not guilty to four additional felony counts involving a teenage relative. Those charges are separate from the child-endangerment case involving the 16 children found in the Hamden home on June 30. Combined with the child-endangerment counts, Elizabeth faces 23 charges and a total bond of $550,000. Her competency report had not yet been filed at her September 16 arraignment. 

Gary Siders Jr. and Christina Siders have also requested competency evaluations. The legal issue now running through this family is not whether competency excuses alleged conduct; it does not. The issue is whether each defendant can understand the case and participate in a defense.
