In today's show I am discussing two topics that have important implications for employers.

The first topic is about discriminatory comments made by a company director about an employee's disability and whether the company had constructive knowledge that the employee was in fact disabled.

The second topic is about whether and under what circumstances emails sent by an employee to fellow employees' business email addresses may or may not be protected by Article 8 (right to privacy) of the European Convention on Human Rights. And where there is not a reasonable expectation of privacy whether the contents of those emails can be used in disciplinary proceedings.
