Colorado Woman Sentenced to 30 Years in Federal Prison for Role in Teen's Fentanyl Overdose Death

Marlene McGuire, a 59-year-old woman from Colorado Springs, has been sentenced to 30 years in federal prison for her involvement in the death of 16-year-old Jameson Burkey, who ingested fentanyl-laced pills. McGuire is the final member of a trio, including Burkey's mother, to be incarcerated in connection with the tragic incident.
Burkey's mother, Maria Cecilia Davis-Conchie, aged 49, was previously sentenced to 10 years in prison last year after pleading guilty to providing drugs to her son and his friends. Court documents revealed that Davis-Conchie introduced Burkey to McGuire and 54-year-old Douglas Floyd, identified as her drug dealers. Floyd also received a 10-year prison sentence last year.
Maria Davis-Conchie was convicted of distributing Xanax to her 16-year-old son and his friends and sentenced to 10 years in federal prison. 
According to court documents detailing the plea agreement, Davis-Conchie engaged in the illegal distribution of controlled substances, particularly alprazolam or Xanax, to her teenage son and his peers for at least a year leading up to January 20, 2022. Prosecutors revealed that she sold the drugs to the teenagers for prices ranging from $5 to $10 per pill, cautioning them against excessive consumption.
Davis-Conchie's actions extended beyond Xanax distribution; she also provided marijuana concentrate and LSD to her son and his friends, believing these substances to be "safe." One notable instance highlighted in the plea agreement occurred around December 31, 2021, when Davis-Conchie purchased Xanax bars and LSD for the group to try on New Year's Eve. s
Davis-Conchie’s plea agreement spells out Davis-Conchie's involvement in introducing her son to other co-defendants, Douglas Floyd and Marlene McGuire, facilitating his purchase of fentanyl pills from them. Floyd, who pleaded guilty to conspiracy to distribute fentanyl and para-fluorofentanyl resulting in the death of Davis-Conchie's son, received a 157-month prison sentence on November 21.
Burkey was found unconscious in a bedroom on January 31, 2022. Court records indicate that the previous day, Burkey and three friends met Floyd outside a Colorado Springs fire station, where Burkey purchased four blue pills for $40. Investigations later revealed that these pills were laced with fentanyl.
U.S. Attorney for the District of Colorado, Cole Finegan, condemned McGuire's actions, stating, "Fentanyl again has ended the life of someone far too soon, and it is infuriating that an adult contributed so strongly to a young person's untimely death."
In asking for a severe sentence for McGuire, federal prosecutors wrote that she "opted to make drug dealing her primary occupation. She was savvy and committed. ... Everyone knows adults should not deal drugs to kids, but the defendant chose to anyway. And she chose to repeatedly deal them one of the deadliest drugs which have ever been sold in the United States, only stopping after she killed one of them."
McGuire's sentencing comes amidst an ongoing case against her in El Paso County, where she faces numerous charges, including organized crime and racketeering. The District Attorney's Office has not announced further actions in light of her federal sentencing.
Maria Cecilia Davis-Conchie is serving her sentence at Aliveville FCI facility in northern Alabama.
