Why Bryan Kohberger's own words might sink the petition he just filed comes down to one moment: a judge asked him, under oath, if he was pleading guilty because he was guilty, and he said yes. 
Thirteen months after that plea, representing himself, Kohberger filed a handwritten petition for post-conviction relief in Ada County District Court. He told the New York Times his actual innocence is his truth and called investigators' account of the case a work of fiction. Before the filing reached anyone official, he called a reporter from a prison phone, and what came out of that call left the families of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin dealing with a scenario they were promised in writing would never reach them. 
The petition claims ineffective assistance of counsel, undisclosed evidence, and a distorted picture of what death row and a life sentence would actually look like, with threats and false promises blamed for the confession itself. He's also said he'd welcome the death penalty being sought again if this reaches trial. 
There's a procedural wrinkle most coverage has missed: the appeal waiver he signed never closed the door on challenging whether the plea itself was valid, and that's the entire premise of this filing. The Goncalves family answered within hours, taking the petition apart in detail.
