Can Alex Murdaugh's Old Testimony Convict Him Twice?

There is a pretrial hearing coming in the Alex Murdaugh retrial, and a stack of new filings landed in front of Judge Debra McCaslin ahead of it. Tony Brueski works through the listener mail with Robin Dreeke, retired FBI Special Agent and former chief of the Bureau's Counterintelligence Behavioral Analysis Program.

Not every motion matters equally, and separating the two is most of the work here. Pretrial practice in a case this size runs for months. A hearing can end with nothing settled and still tell you where a judge is leaning.

The filing with real reach is the one seeking to put Murdaugh's own sworn words in front of the second jury. He chose to take the stand in 2023. Nobody compelled him. If those words come in, his lawyers are building a defense around explaining them, whether or not he ever testifies again.

The rest tighten the edges. Two of them close doors the state already closed once, one asks for another look at the digital material, and one blocks a defense testing request.

Judge McCaslin has told the attorneys she knows nothing about the first trial and expects them to be thorough when they explain it. She tentatively set the retrial for April 5, 2027.

The South Carolina Supreme Court threw out Murdaugh's convictions over what the clerk of court told jurors. He is presumed innocent at the retrial and has denied the killings throughout. He stays behind bars either way, serving concurrent state and federal financial crime sentences of twenty-seven and forty years.
