Why Fernandez's Lawyer Almost Fell Out of His Chair

The most revealing moment of closing arguments in Mario Fernandez's murder trial wasn't a piece of evidence. It was defense attorney Jesse Dreicer telling the jury he almost fell out of his chair. Prosecutor Stifler, he said, had claimed Fernandez moved $50,000 from Shanna Gardner's account to his own after the killing. Dreicer walked the jury back through Detective Johns' financial testimony and said the records showed only two small transfers.

Dreicer spent over two hours dismantling the prosecution's circumstantial web. He played a recorded phone call where Fernandez praised Tenon for handyman work eleven months after the murder — captured without Fernandez's knowledge — and called it the strongest proof the checks were for legitimate labor. He pointed out that investigators found six 10mm Glocks at a single pawn shop and never checked whether any connected to the case. He reminded the jury that Tenon is alive, could have testified, and the prosecution chose not to call him.

The prosecution's rebuttal came down to one frame. Fernandez is connected to every thread of evidence. His phone went dark during the hour of the murder. He wiped it after Tenon's arrest. He never called Shanna when police announced they'd caught the killer. Either all of that is coincidence, the prosecutor argued, or it's guilt. The jury begins deliberations Wednesday.
