Richard Allen's Prosecutors Say They Can Win Without the Confessions Using This

The State of Indiana stood in front of three appeals judges on September 21, 2026, and said the Delphi murders conviction of Richard Allen survives even if every confession is thrown out. This segment is about what the state means by that, and what the defense says is actually left.

Richard Allen is serving 130 years for killing Abby Williams and Libby German in February 2017. His appeal lawyer, Mark Leeman, told the Indiana Court of Appeals that no witness identified Allen as the man on the bridge and no DNA connects him to the girls. The physical evidence is an unfired .40-caliber cartridge found between them, which a state police examiner matched to the Sig Sauer taken from Allen's home. Leeman called that match astrology, and reminded the judges that Judge Frances Gull kept the defense's metallurgist, William Tobin, from telling the jury why the method is disputed.

The eyewitness is Betsy Blair, who saw a man on the bridge's first platform from about 50 feet and helped police make a sketch. Gull ruled the sketch inadmissible hearsay. Leeman held it up in rebuttal and told the judges that if Blair didn't see his client, nothing else matters.

Deputy Attorney General Ellen Meilaender's response is that the case stands without the confessions. Allen told a conservation officer in 2017 that he was on the trail that afternoon, and she argued that statement alone gave police probable cause to search his house and remains the state's strongest evidence. The defense says the search warrant affidavit twisted witness descriptions to fit Allen; the state says take out every disputed line and the warrant still stands on his own words.
