DA Nathan Hochman announced that the state will not seek the death penalty against Nick Reiner in the murders of Rob Reiner and Michele Singer Reiner. Hochman said the Reiner siblings made their views clear in conversations with his office. Sources say the victims' own beliefs about capital punishment — Rob Reiner was a vocal opponent of the death penalty throughout his life — played a significant role in the decision.Hochman reversed his predecessor's moratorium on seeking death in March 2025 and spent nine months positioning capital punishment as a live possibility in this case. California hasn't executed anyone in two decades. The execution chamber was dismantled in 2019. Nearly 600 people sit on death row with no path to the chamber. The death penalty in this state is a press conference.With the maximum sentence now life without parole, the case pivots to the question prosecutors have been building toward since the grand jury indictment. Nick Reiner has a documented psychiatric history including schizoaffective disorder and a 2020 conservatorship. His doctors allegedly changed his medications weeks before the killings. But California requires the defense to prove insanity, and the lying-in-wait allegation in the indictment says Nick planned an ambush — that he concealed his purpose, waited for his parents, and attacked. A man who planned an attack understood what he was doing. That's the prosecution's argument, built into the indictment before the trial begins.
