Before his guilty plea, Bryan Kohberger's defense filed a notice saying he was out driving that night — looking at the moon and the stars. No witness. His phone was off. Now he's asking a court to throw out his plea and let him argue it. The prosecution had DNA on the knife sheath, a Ka-Bar knife purchased with a gift card, over twenty phone pings near the house, and surveillance footage. A roommate identified him inside the home. The plea deal removed the death penalty. If it gets vacated, prosecutors already had a death notice filed. Eric Faddis, defense attorney and former prosecutor, breaks down the evidence wall, the alibi that already failed one test, and what realistic chance Kohberger has of ever seeing the inside of a courtroom again.
