Trial Of Caleb Flynn Day 2: David Hammond Found WHAT at Garage Door?!

Special Agent David Hammond's Day 2 testimony focused on a basic question in the Caleb Flynn trial: did the physical damage at the house look like someone had broken in? Hammond, an investigator with the Ohio Bureau of Criminal Investigation, photographed the Tipp City home where Ashley Flynn, 37, Caleb Flynn's wife and the victim in this murder case, was found dead. 

He testified that he photographed doors, windows and the home's possible entrances and exits. At the garage door, Hammond found a broken handle. What he did not see, he told jurors, were marks in the soft wood around that handle that would indicate someone had tried to force it. A refrigerator was also positioned against the door. Hammond said the deadbolt was undamaged and the door frame showed no damage. 

The defense maintains that Ashley was killed during a home-invasion burglary and that investigators locked onto Caleb too quickly. Prosecutors allege Caleb Flynn, 40, staged the scene to create the appearance of a burglary after killing Ashley. He has pleaded not guilty to all charges. 

Hammond testified that the garage area was inconsistent with burglaries he had investigated in the past. Aside from the broken handle, he said he found no evidence that the door had been broken open. That is an opinion from the state's investigator, and jurors will decide how much weight to give it. 

The point of this part of the testimony is unusually concrete. If a stranger forced a way inside, the defense's theory needs the house to support that possibility. If the visible damage does not line up with forced entry, prosecutors gain another piece for their staging allegation. Hammond's photographs and his explanation of what was missing around that damaged handle put that dispute directly in front of the jury.
