Caleb Flynn Trial: Prosecutors Say Look at Everything, Defense Says WHAT?

Closing arguments in the Caleb Flynn murder trial came down to what jurors believe the evidence can actually establish. Miami County Assistant Prosecuting Attorney Matthew Joseph urged them to consider the evidence together, arguing that its combined weight is overwhelming. Lead defense attorney L. Patrick Mulligan answered with a much narrower question: where is the proof that Caleb killed Ashley Flynn?

Caleb Flynn, 40, has pleaded not guilty to 11 charges, including aggravated murder, stemming from the death of his wife, Ashley, inside their Tipp City home on February 16, 2026. Prosecutors allege Caleb staged the scene to look like a home invasion. His defense says Ashley was killed during a burglary and investigators focused on Caleb too quickly.

Joseph's closing treated the case as a collection of evidence that must be viewed in context rather than as disconnected pieces. Mulligan argued that circumstantial evidence does not relieve prosecutors of their burden to prove Caleb committed the killing beyond a reasonable doubt.

Mulligan also confronted the affair directly. His position to the jury was that prosecutors had established Caleb was unfaithful to Ashley, but that proving an affair is not the same thing as proving murder.

Then came the line that defined the defense closing: “You make the call.” This episode puts both arguments side by side before the jury begins making exactly that call.
